The owner is a friend of his who is an ex-Sega employee. He's currently looking into the legality of releasing them, so whether they will be or not is up in the air at this point. You have to keep in mind that some of these companies are still around, including Codemasters, so chances are, he would need permission from them or legally he can't release them.
I think that raising a legality issue for not releasing the games is nonsense. Even if we assume that the company behind the "Take the Bullet" (IF they still exist as a legal entity), or Codemasters, or any other company for that matter, would go into the trouble of pursuing the case legally, how would they EVER be able to track the person who leaked the Dreamcast game?
In the case of Half Life or Propeller Arena, someone leaked a fully playable game at a point in time which was much closer to Dreamcast's production life and there was not even a whisper from Valve or Sega. How on Earth would someone make an issue out of a 15-year old version of a game that hadn't even reached Alpha version? Releasing these videos is fine but not such a big deal. Releasing the games has actual and practical value for the community.
