Ok, this happened like half a year ago, but I think it may still be of interest since most of the homebrew stuff happened over there: DCEmulation.com moved to DCEmulation.org.
DCEmulation.org is the oldest Dreamcast forum today and most of the homebrew developers are over there. Esspecially for the technical stuff it's the #1.

Nope, it was completely legal. The content of all the forum posts were never his, and he hadn't contributed to the site in years.
